County Sues State Over Medical-Marijuana ID Law

SAN DIEGO -- The San Diego County Board of Supervisors isn't waiting for someone to sue over the board's decision to refuse to follow state medical marijuana laws.

The supervisors voted in closed session Tuesday to file suit first. The lawsuit will challenge the law that requires counties to provide identification cards to medical marijuana users exempting them from criminal prosecution.

The dispute is over Proposition 215, passed by the voters in 1996, and a follow-up measure by the state Senate in 2003. The laws permit users of medical marijuana to show identification cards that would keep them from being prosecuted under state laws.

Last week, San Diego became the first county to refuse to act on the state's requirement that counties establish an ID card program and maintain a registry of those who voluntarily apply for the cards.

Then San Diego should be taken over by the state militia and forced to comply at gunpoint.

Is this a bad thing for San Diego County medical users or a good thing? if they don't maintain a registry of patients that's good right? This doesn't mean that medical marijuana will be outlawed in SD county will it?

My thinking was, when I first read this article, that this would be a good thing for San Diego County medical marijuana users. The reason being that the ID cards provide a system by which medical marijuana patients can be easily identified and therefore if the Feds ever want to target medical users for arrest it would make it very easy for them.

On the other hand, San Diego NORML believes that having the cards is vital for medical marijuana users to enable them to get their medicine from dispensaries all over the state of California, therefore a bad thing. Also, if a patient was pulled over with an ounce of medicine in the car, not having a card could leave them open to prosecution.

But, no I don't think that medical marijuana become outlawed since Proposition 215 was passed and made medical marijuana legal. Of course, it is against Federal law, so it will be interesting to see how this plays out.

Yeah, i guess we'll see what's to happen. I'm sitting in on the next meeting of the san diego med mj task force so i'll know what's up.

I see it as extremely alarming news. They filed suit against prop 215

WASHINGTON — San Diego County is just saying "no" to enforcing a California law passed last December that requires counties to give ID cards to registered patients who use medical marijuana so they won't get busted for having pot.

"To use medical marijuana cards and at the same time go after gangs and what they're doing, it's absolute hypocrisy to me," said San Diego County Supervisor Bill Horn.

In 1996, Californians were the first in the nation to pass an initiative legalizing marijuana for medical purposes.

"Patients ought to be able to have access to medical marijuana. Everyone agreed by vote that's what we want," said Jerry Meier, chairman of the county's Medical Marijuana/Cannabis Task Force.

Thumbing their noses at Sacramento, earlier this month county supervisors voted three to two against issuing pot ID cards. The supervisors plan to sue the state, arguing that any marijuana use violates federal law.

County attorneys have warned that litigation will be costly and likely lose in court. The supervisors' response — they're up for the challenge.

"We think the federal court has to make that decision. Who's right, who's wrong. I mean, you put us in the middle here," Horn said.

Medical marijuana advocates say the voters have spoken and counties should listen. They add that they worry innocent patients will face prosecution.

"You could have someone coming down here from up north with their card, getting pulled over by a sheriff ... and it costs you in the county thousands of dollars in a lawsuit because they weren't enforcing the state card program," Meier said.

For now the lawsuit shapes up as San Diego County versus the state of California, but legal experts say it's unlikely to remain within state borders and could wind up in federal court, another test of whether the central government or the states have the right to decide if medical marijuana is legal.
