Alleged drug dealer charged as habitual offender requests attorney

EVANSVILLE — A man charged with allegedly dealing drugs and fleeing police with handfuls of cash told a judge Tuesday that he didn’t have the money to hire an attorney.

Armando Gutierrez, 27, appeared in Vanderburgh County Superior Court by video from jail Tuesday. He was arrested on Oct. 19 after allegedly climbing out of a window at 1608 Monroe Ave., near Washington Middle School, and attempting to run away from police officers, according to an affidavit describing the charges against him.

Gutierrez was charged with dealing a controlled substance within 1,000 feet of a school, dealing marijuana, possessing a controlled substance within 1,000 feet of a school, escape, maintaining a common nuisance and obstruction of justice, all of which are felony charges. He was also charged with possessing drug paraphernalia and resisting law enforcement, Class A misdemeanors.

Deputy Prosecutor Mike Lamb also said Gutierrez will face habitual offender enhancements on several of the felony charges, which could triple their sentences.

When Judge Richard D’Amour questioned Gutierrez about his assets to hire an attorney, the inmate replied that police had confiscated the only cash he had. He described $268 police found in a bedroom where he had been staying as tips from a restaurant job.

However, according to the affidavit, police saw Gutierrez running from the back of the house with “a large sum of cash in his hands.” Officers recovered $1,495 from him, $350 cash was found in the living room.

When D’Amour asked Gutierrez if anybody owed him money, several inmates sitting behind him in the jail’s video conference room snickered.

D’Amour found him indigent and appointed the Public Defender’s office to represent him.

Gutierrez then asked the judge, “Is it too early to file discovery? I want to know what they have against me.”

“You should discuss your trial strategy with your lawyer,” D’Amour said.

Officers were led to the house after an Evansville Police Department liaison officer at Bosse High School smelled burnt marijuana on two students and questioned them, according to the affidavit. The students then told him where they got it from a person named “Kyle” and described the location of the house.

When police went to the house and identified themselves, the report said, Gutierrez allegedly fled through the backyard but was caught. Police then found Kyle M. Jones, 26, and Amanda J. Richter, 27, inside the house, according to the affidavit.

Police reported seeing drug paraphernalia throughout the house while looking for other people and then obtained a warrant to search the property.

At one point in the investigation, according to the affidavit, Gutierrez allegedly ran into bathroom while still in handcuffs and began throwing pills into a toilet before police stopped him. As police were taking him to a patrol car, Gutierrez allegedly broke away from officers again and was caught between houses after a short chase on foot.

Police seized a black Audi car. Inside the home, police allegedly found 190 grams of suspected marijuana, paraphernalia for using and selling drugs, and bottles of several prescription pills and narcotics, including oxycodone.

Gutierrez is being held on $5,000 cash bond.

Jones and Richter were arrested on preliminary charges of maintaining a common nuisance and released on $250 cash bond. The Vanderburgh County Prosecutor’s Office filed additional felony charges of dealing a controlled substance and possessing a controlled substance against each of them.

I hope "Jones and Richter" know that someday that guy's going to get out of prison...

If they hadn't talked, probably no one would have gotten anything. So what if you smell bad. That's not possession. :facepalm:

those kids better get beaten up at school. that guy was probably a dealer for a lot of other people
