paraphernalia charge

Howdy,
So I got caught with a bowl in my car a couple months back and I have court coming up.
I'm really unsure of what to do here. I'm going to try to get a continuance, but I'm not so sure that's going to work.
I can plead guilty and pay the fine of $750-$1,000 or I can try to fight it. I'm wondering how well fighting it would really go as I don't want to spend $ on a lawyer and additional court costs. If I fight it and am found guilty, is it essentially the same thing as having plead guilty in the first place?
Also I'm wondering if this charge will hurt my future employment opportunities and things of that nature?

If you plead guilty and save them a trial I bet it wont be as much as you think. I def would not take a charge like that to trial, lol, that would piss them off somethin fierce.

I had same thing happen in august. Ask for a deferred judgment. Basically self supervised probation bullshit. Just behave yourself, and after youre done with that, the charges are cleared. But be careful, only get two of em in ur life

Yeah, I know, it's fucking ludicrous.
The best part about it: in my state, all paraphernalia is treated the same. Doesn't matter if it's a roach or a crack pipe.
I'm also wondering if I fight it, is it likely they will just want to cut a deal and give me a lesser punishment just so they don't have to waste time in court for a simple charge?

Hello.. first off, I'm sorry that you got caught..pretty unfortunate..anyway..
it all depends on how good the lawyer is and the money you want to spend. my girlfriend recently spent $500 trying to fight a possession charge (we got caught with a cahsed bowl, and they charged us with both possession of paraphanallia, AND marijuana less than an ounce for a cashed bowl), and lost.. she was charged with both.
as far as your charge affecting your employment.. if you list the charge on an app, you probably won't get the job.. unless it's like fastfood or something. but if you are currently employed, unless you have a GOVT job, they can't fire you for it or anything, because it deals outside of the workplace...

With a charge like yours, going to trail would be an easy victory for them. It's a tricky situation like it might be with a stack of charges. I wouldnt try it. Id just plead out right then and there.

Yeah, I'm hoping to get something along those lines.

I paid like $667.85 total for both possession of para., and marijuana less than an ounce. My birthday week too.

If any state tried to charge me that much for some simple bullshit like that they'd be forced to issue what they like to call a fugitive warrant. I would disappear into that good night and those pigs would never see my white ass again.

im sure a lot of the specifics will vary from state to state, as far as fines and diversion programs and such. when i was 19 i got charged with possession of marijuana, paraphernalia, underage possession of alcohol, and an open container in a vehicle.
the plea was to plead guilty to the underage possession of alcohol, and have the rest of the charges dropped. i had to take a couple of drug/alcohol education classes, and once completed it was like it never happened... well, as far as my current record goes anyway. im sure theres still a record of it somewhere. the only catch was it was strictly a one time thing.
that was also ten years ago, not sure if thats how they still do it here or not. id at least talk with a lawyer or public defender to see if you got a case. id probably still end up going with the plea and paying the fine. just try to be more careful.

Believe it or not thats actually what a buddy of mine did and he ended up getting the charge dropped. Got caught with a 10 sack, and pleaded not guilty. His public defender says he wished more people would plea not guilty on small weed charges because then they might stop prosecuting it.
Im in cali so who knows

i plead guilty from the start, but only on the one charge. the deal was set before i had any court though. all i had prior to that was a chat with the public defender, where we discussed the options and such. i definitely suggest you do something similar before entering any kind of plea.
