Marijuana smoker ordered to relocate

LOCKPORT—Niagara County Judge Sara Sheldon Sperrazza on Wednesday gave a hard-core marijuana smoker 30 days to get out of town.
Court-ordered relocation was the main point of a probation sentence imposed on Brian P. Renaud, 31, of Old Ransomville Road, Lewiston.
“He’s moving to California, where marijuana may be legal,” she said, “because if he doesn’t, he going to jail.”
Sperrazza said smoking marijuana is “all he cares about.” When Renaud pleaded guilty in April, she ordered him to sell his house, but defense attorney Thomas J. Eoannou said Renaud has been unable to do so.
Renaud pleaded guilty to attempted second-degree possession of marijuana after police raided his home Dec. 15, 2008, and found 3.84 pounds of the drug. Renaud served three years in prison after a 2004 arrest for having 31 pounds of pot.

How can they legally do this? Usually probation means you CANT leave town, doesnt it?

Better yet, fix this problem and legalize marijuana.

She didn't order him to even move to a different state.. just a new town.
