Felicity police officer indicted on drug-related counts
BATAVIA - The captain of the Felicity Police Department faces up to 10 years in prison after being indicted Wednesday on drug-related charges of tampering with evidence and records.
Capt. Delmas "Gee" Pack Jr., 42, of Monroe Township, who was arrested last week in a sting operation involving fake pills, remains free on $100,000 bail.
Ray Hesler, chief of police in Felicity, said he testified before the grand jury but didn't think he should divulge what he told jurors.
However, Hesler said, he doesn't plan to fire Pack.
"He's still on the force," Hesler said. "I'm not about to kick a man off that's not been proven guilty. A grand jury indictment don't mean you're guilty."
But Hesler noted that Pack's police powers had been suspended by a judge.
"He's not going to get paid," Hesler said. "He's not riding around in a cruiser or anything else until we get this settled."
Pack allegedly confiscated 80 fake Oxycontin pills from an undercover police officer working with the Clermont County Narcotics Unit and then claimed he had disposed of them, said Daniel "Woody" Breyer, the county's chief deputy prosecutor.
"They're all gone," Breyer said of the fake pills. "No one knows where they are. (Pack) maintains he threw away 50 of them - flushed them down the toilet. The other 30, who knows."
A number of complaints have been made over the years by people who said a Felicity police officer confiscated illegal drugs but never filed charges, Breyer said.
"There are a lot of reasons why those people don't want to come forward and go on the record," Breyer said. They could fear being charged - or fear for their safety, he said.
The sting involved putting "an undercover police officer in the same position as a lot of these previous people who have complained," Breyer said. "In other words, put him in Felicity appearing to possess a lot of contraband materials, and then create a contact between the officer and Captain Pack."
That involved creating a fake criminal identity for the undercover cop, then calling Felicity police while Pack was on duty by himself to report there was someone suspicious in a car in a parking lot in the village, Breyer said.
The tampering with records charge "pertains to evidence logs and police reports involving this incident and previous incidents ... this year," Breyer said.
The prosecutor declined to comment on what Pack might have done with drugs he allegedly confiscated but didn't file charges on.
Pack has been an officer with the Felicity Police Department for 16 years and the captain for about three, Hesler said.
The chief said that Pack makes lots of drug arrests, which spurred complaints about him by criminals.
"If he was doing something wrong, I sure didn't know it," Hesler said.
"There's no one else that we're looking at right now," Breyer said of the Felicity Police Department

yeah i know its terra bad when a cop takes all your dope but lets you walk free without a criminal record or fines, or probation, or anything else. what was this cop doing that you all dont like again?? his only crime here is that he is a cop. you guys are douches!

No, his only crime was doing god knows what with confiscated drugs.
Generally when a cop confiscates drugs, it's frowned upon for them to consume them or sell them or do anything other than dispose of them.

True, but at the same time im with above. I'd rather them take my weed and smoke it, then charge me. Point being, is that you got caught PERIOD. At least these folks didnt get charged and their life ruined.Quote:

Like is aid, someone watched Bad Lieutenant too many times. Ive gotten caught with weed twice, and i only wished they would have took it and smoked it!!!!!

Initially I was surprised to read the title, then asoon as I realized it was in the country that it was I was no longer as shocked as I was, if this had happened in america then it would be quite the story.
