ANNAPOLIS -- A bill to limit use of the hallucinogenic herb salvia passed unanimously in the Maryland House of Delegates, where legislators await a similar bill to pass the state Senate.
The bill prohibits distribution of salvia divinorum to anyone under age 21, but does not prohibit medical research on the drug. Earlier versions of the bill would have imposed an outright ban.
According to bill provisions, violators would be charged with a misdemeanor subject to a maximum $300 fine for a first violation. A second violation within two years of the first could bring a maximum fine of $1,000. Subsequent violations also within two years could bring additional fines up to $3,000.
District 38B Delegates Norman Conway and James Mathias, both Democrats, sponsored the bill after learning the popular drug had been sold legally the last few years at shops along Ocean City's Boardwalk, frequently to young people. A similar bill failed during the 2009 legislative session.
The Ocean City Town Council banned sales and possession of salvia within the limits of the resort in August under the guidance of Attorney General Doug Gansler. Worcester County also took steps to ban the drug's sale in 2009.
A cross-filed bill in the Senate sponsored by Sen. Richard Colburn, R-37-Dorchester, passed favorably on second reading March 22. A third reading would send the bill on to Gov. Martin O'Malley to be signed or vetoed.
Derived from a sage plant, salvia can be smoked like marijuana or used as a tincture in tea. Users say they experience brief but intense hallucinogenic experiences, in which they feel "outside themselves."
The plant has reportedly been used for centuries by indigenous Mexican tribes for spiritual ceremonies. Salvia made its way into the United States in the early 1990s and is not illegal on the federal level.

I am actually for this. However I think the age should be 18 not 21. But yeah, I think there needs to be a legitimate regulation of the herb rather than an outright ban - and there needs to be consequences for putting it in the hands of children.

:-) I was very glad to read this peice of news, although call me crazy, I do think 21 is quite reasonable.

with 21 at least you know the brain is somewhat finish in is development and the damage of x and y substance will be less.
But, some people of 15 are more mature than some of 21, so the usage of substance can be abuse by a 21 and respected with a 15.
Age is just a number, nothing else.

Awesome! These are the sorts of changes we need to see in our drug laws. I applaud Maryland politicians for their sudden outbreak of common sense.

Wow...I'm surprised and please by the sense and sensibility of the legislature on this one.

Yep. Way to go Maryland on not being insane. Politicians get to have the reputation of protecting the public and we still get to have salvia.
