TOPEKA — A bill banning synthetic drugs that replicate the effects of marijuana and Ecstasy won approval in the Senate on Thursday.
The measure, Senate Bill 348, passed 36-1, with Kansas City Democrat David Haley the lone vote against it.
"As our youth and others continue to search for legal ways to expand their flights of fancy, I fear they will encounter more dangerous ways than what we ban here," Haley said.
He noted that the move to ban two synthetic cannabinoids found in K2, which replicates the effect of marijuana, comes as many states are expanding legal access to the plant itself.
The measure would also ban BZP, which replicates the hallucinogen Ecstasy.
Kansas would be the first state in the nation to outlaw K2 if the legislation passed Thursday by the Senate is made law. The bill still must go to the House.
Possession of K2 or similar products would be a misdemeanor under the bill.
Kansas law enforcement officials have said high school students are using the new synthetic drugs.
Most lawmakers did not agree with Haley, saying they wanted to ban K2 before it became widely abused.
Sen. Jim Barnett, R-Emporia, a physician, said he was voting for the ban after seeing first-hand the impact drugs could have on people's lives.
"Even though it is an imitation drug, it is still a drug," he said.
A Lawrence store named The Sacred Journey sells K2, an herbal incense, for as little as $15. John Knox, a lawyer for the business, said it's the store's most profitable item.
Knox said there's no evidence that K2 or similar brands cause any health effects or are addictive.
He said his client would continue to fight the legislation until it becomes law. He said a petition opposing the ban on K2 was signed by 1,500 people. Contributing: David Klepper of The Eagle's Topeka Bureau

I live in the most naive state. Why does our Western bordering state (Colorado) have medical cannabis and our Eastern neighbor, Missouri, is voting it through as we speak. But in Kansas we are to worried about outlawing even more synthetic drugs that replicate the effects of cannabis. Another step backward.

i live in KS as well, KS is at the heart of the 'bible belt'. i was talking to the owner of a smoke shop here a few days ago and they said that this state wont let us have anything that changes ones mental state. i actually went and purchased 2 grams of K2 when i heard that it was about to be made illegal. i need to ditch this state...

The synthetic cannabinoids (Nearly all JWH-xxx compounds, others) are some very dodgy compounds. Aromatic hydrocarbons, and there is a good deal of well-founded speculation that any decent amount of smoking of these substances could be QUITE cancerous.
Regardless, ass-backwards kansas and ass-backwards U.S. policy makers naturally will refuse to even consider any kind of SENSIBLE, empirical study of these substances or any others for that matter...

You're damned right they will. Better to legalize the least harmful drugs!
