Confiscated: They left my home with the following items of concern: . - One 5-cup capacity Tupperware, ¾ colonized on typical BRF substrate. - One pint jar containing a 300ml quantity of 24-hour old LC - One 6 month old pint jar that was ½ full of coir/verm but, unfortunately, had formed internal pins. - One dehydrator with “crumbs” on the bottom – mostly aborts that fell though. . In addition, they confiscated: - One gram scale - One milligram scale - All of my cultivating supplies (agar kit, filters, tapes, vials, empty syringes, etc). . As far as what’s just flown right off the top of my head, that is all the information I feel safe providing. Let’s assume, for the sake of entertainment, that ALL items confiscated will test positive for some amount of psilocybin at the lab, which is 3-4 months backlogged.

I want to open this post by saying that I’m scared to death to even post about this in forum. Regardless, I feel it is important to do so anyway for several reasons. One of these reasons is the possibility that someone else like me may be able to glean some useful information from my experience. Another reason for posting is that, for an absolute certainty, I know I cannot trust the cops or the lawyers. Both have lied to me repeatedly throughout this entire ordeal. From good-cop-bad-cop to attorney scare tactics to get me on the hook for a small fortune in debt, people have been trying to railroad me non-stop. Hopefully the community here can provide some insight and advice as to how to handle what I’m certain is rapidly coming down the pike. No one here knows me and no one here has anything to gain from lying to me, so I can only hope for the best. The final reason for posting here is to see if anyone has any tricks up there sleeve in preparing a defense or pointers on how best to handle various situations that may arise during trial. . I know most people are probably going to say to “just trust your lawyer”. Unfortunately, I have only lived in my state for a year, so I know far fewer folks here and most of them I don’t know well enough to ask for suggestions on a lawyer. I’ve shopped around for sure. The first attorney I spoke with said he wanted a $3,750 retainer and claimed that I could be facing a “Class X Felony” with a mandatory minimum of 6 years and a maximum of 35 years. He said defense for that would run me $25-35,000 dollars, which I simply do not have. The last attorney I talked to said a “Class 4 Felony” at the MOST and I would receive is a 1st time offenders probation and some community service. He asked for a $1,000 retainer whenever I felt like dropping it off and to not worry. He made it seem like it wasn’t a big deal at all. Honestly, I can’t help but think that BOTH these attorneys are railroading me. One wanted to scare me into bankruptcy, the other just wants a quick grand and then he’ll throw me to the wolves. Honestly, I’m friggin petrified scared crazy shitless! . And so on with the story: . Background: I have been a hobbyist cultivator, off and on, for the better part of a decade. I’ve attempted some random edibles, having the best success with shiitakes and oysters. Most others edibles I’ve completely bombed, but had fun in the process regardless. This time around, I was just about to start a shiitake grow using a shotgun chamber and the standard BRF/PFTEK rundown. I’ve grown them from logs before, but never from cakes, so I was intrigued by this method which was posted by a very popular and trusted cultivator here. I had nearly a full pint of LC colonizing a live shiitake culture I received from a popular online vendor and a Tupperware of toothpicks colonizing as well. The containers were in my living room, in plain sight from the living space, but NOT from the front door. . My wife and I were arguing loudly about finances. We have a very “troublesome” neighbor who has had the police called on his residence (never from us) for partying to loud, too late on several occasions. He now has a major chip on his shoulder and calls the cops every chance he gets just to get even I guess. I’ve had other run-ins with this unpleasant creature of darkness and there is no love lost between us. Needless to say, the cops were called to my residence because my wife and I were apparently yelling pretty loud – financial arguments during the holidays are never pleasant. Please understand that there was absolutely no violence, or alcohol or drug consumption involved here. No one was arrested for domestic anything. I receive a heads-up from another concerned neighbor that the cops were on their way. I still have no idea how they knew – I can only assume that they were in proximity to my evil neighbor when he called the cops. I’ll find out one day when I make my way over there to shower them with thanks and praise. Anyway, it was in my best interest to temporarily vacate the premises for reasons that I hope are clearly understood. I returned approximately 15 minutes later to no less than 4 cop cars. When they asked where I went, I told them that I wanted to leave and wait until they arrived so the situation didn’t escalate. . For a bit more background, I live in a very popular burb west of a major northern US city. When I arrived, the police were already standing in my apartment – which was a shock to me because my wife KNOWS the deal. After speaking with my wife, they had apparently followed her into my apartment “in favor of a quieter place to talk”. My wife had asked the cops to wait for a second while she went to check on our youngest. When she came back from the little-one’s bedroom, the police were in our living room, and already looking around. I KNOW that this is NOT supposed to happen. They almost immediately noticed the several jars/containers that were on my desk, which is located in the general living area. They saw my shiitake LC, my Tupperware with an envelope full of shiitake-colonizing toothpicks and some ½ pints of homemade PDA agar for an attempt at an isolate. Needless to say, despite the fact that all of this is completely legal, they found it to be highly suspicious. They asked what they were and I told them. Next they asked if the mushrooms were “those magic silly-sy-bee-in mushrooms”? Obviously, my answer was an emphatic “no” and attempted to bring attention back on the REAL issue, which was police responding to a potential domestic call. Obviously, a false alarm. Have a nice evening officer’s and I apologize for the trouble. No such luck. . At this point, the local police asked me to “take off for a few hours” to let things cool down. I said that that wouldn’t be necessary, but they were adamant. They claimed that someone almost ALWAYS was arrested on domestic calls and that I should listen, thank my stars and come back in a few hours. If they got called back, there would be trouble. So I left, feeling hopeful that it was all over, only to get a call in another 15-20 minutes from a different office requesting that I come back immediately to talk about “my mushroom grow-op”. I was no longer dealing with the local police. The group that was there to greet me the second time around were from my county’s very own private narcotics division – some sort of county-wide DEA or something. They were not very pleasant. . They had pretty much ransacked my home by the time I arrived back for the second time. Stuff was being bagged, swabbed and hauled out left and right, in front of my neighbors and everything - talk about embarrassing. I was told to sit on the back staircase of my building. There were only two exits and cops were blocking both of them. I was told I couldn’t go into my home. I was told I couldn’t leave. I was told not to make any phone calls. I asked to speak to an attorney (not once, but four times!) and they laughed at me and kept on with the interrogation. They said, “If you want to play hardball, than that’s just fine.” I was told that, “a lawyer only wants to scare me and take my money”. I was adamant, but they continued to threaten my freedom, my job, my home, my children and pretty much anything else they could think of. What they really wanted to know was what I took from my apartment when I left, where it was and how long it would take to retrieve it. Of course, I ensured them the there was nothing that needed to be retrieved and that was that. They did everything they could from playing “good-cop-bad-cop” to telling me that they already performed field tests in their car that came back positive for large “amounts of psilocin”. I know, laugh it up. Telling me that they read my mind would have been more convincing. Even if I didn’t know that such was impossible, the fact that I was standing there without cuffs was proof against the lie. The scariest part was when the one rabid-looking cop told me he’d have Child Services take my children for exposing them to a Psilocybin Mushroom Grow (as if it were nuclear waste or something). I reminded him that toxic mushrooms also grow in the back yard, in the school yard and on the playground. This concept seemed quite revolutionary to him. In the end, they chose not to arrest me, but they were far from happy about it. My assumption was that they were hoping to run me in as a “freebie” without having to work for it. . They left my home with the following items of concern: . - One 5-cup capacity Tupperware, ¾ colonized on typical BRF substrate. - One pint jar containing a 300ml quantity of 24-hour old LC - One 6 month old pint jar that was ½ full of coir/verm but, unfortunately, had formed internal pins. - One dehydrator with “crumbs” on the bottom – mostly aborts that fell though. . I’m not really too concerned about the scales, though I know they can be regarded as paraphernalia (maybe I should be?). I use valerian root extract to assist with sleep sometimes and I buy it from an online vendor in powder form. This is exactly what the scales are for. . As I said, the attorneys I spoke to ranged in consequences from “6 years, $25,000” all the way to “no chance of jail and community service”. . I am in my 30s. I am married with two children. I am a career technology professional, working for the same company for 6 years. I am highly educated. I actively serve in my community, volunteering 6 hours a week for the last year teaching martial arts. I have absolutely no convictions on my criminal record. My only two arrests were for misdemeanors - underage smoking and fighting and such when I was still in my teens and early 20’s – again, no convictions. . What am I looking at? What can I do? I’ve already come to terms with the fact that my family will be having a really bleak Christmas this year. I can deal with that, so long as I’m free and clear to suffer through it with them! . I know I have relatively few posts here, but I’ve been a lurker since 2003. I know I don’t have much credit here – never traded prints with anyone, never posted a grow log or anything. I was always too sketched out. Regardless, you now have the story. Feedback will be appreciated more than you can know. If you’re not certain about your info, please don’t post about how I’m screwed and they’re gonna nail my balls to the wall. I’m already scared enough and I’d really hate to shit my pants while I’m here at work. Otherwise, I’m preparing myself for the worst. . Negatory - was growing non-actives. Busted for remnants of a previous grow, burried in my bedroom closet, that are pending lab testing. These were not shiitakes.
The trouble is... You were not doing anything illegal. PERIOD.
If that is true, then you are OK.

Seriously my friend, you must contact Richard Glen Boire for this case. He is considered by many to be an expert in mushroom related offenses. At least consult with him.
You see... this is VERY difficult. The items confiscated were NOT shiitake. They have yet to be tested in lab. I'm posting what's currently ON RECORD... ya know?

Now you're changing the story... I read the full story. Was the previous grow, an active grow, or was it a non-active grow? If it was a non-active grow then I don't understand why you would say "negatory?" The mushroom strain is irrelevant as long as it's not a psilocybin or psilocin containing species...
I read that whole thing buddy... I know what your going through!!! i got raided once and got pinched hard . The smartest thing you did was not make a statement (they always push hard for one!!!!). They were hoping you would just admit you grew "magic mushrooms" and signed it and it would be done for them.
So the only mushrooms you were growing where legal? if so your probably good for charges.
And as for a lawyer... a shitty (cheap /court appointed) will not put the time in your case. He usually recommends you to take the "deal" (admilt guilt to "lesser charge").
While a Good layer ($$$) will work to get you off free or almost free, by working with you case. A Good lawyer is what you need. Here there is one amazing drug lawyer who works for all the bikers, and is wicked!! he was my lawyer and did real good for me!
