Man sentenced for biting policeman

COURTHOUSE — A homeless man who admitted biting a Norristown police officer last year was sentenced to prison earlier this month.
Miguel Flores-Garcia, 51, was sentenced to two to four years in prison and five years’ probation on Sept. 4, according to Montgomery County Assistant District Attorney John Walko.
The defendant pleaded guilty in June to aggravated assault in June for biting a Norristown policeman while resisting arrest following a reported hit-and-run crash. Common Pleas Court Judge William R. Carpenter ordered him to undergo a mental health evaluation when he pleaded guilty.
Flores-Garcia reportedly had hepatitis C at the time he bit the officer, but the policemen was not infected by the virus, according to Walko.
At 4:30 p.m. on May 7, 2008, Norristown police were dispatched to a hit-and-run crash at West Main and Cherry streets. According to authorities, an older model BMW struck a parked car, then fled the scene.
Twenty minutes later, a Norristown police officer saw a gray BMW fitting the description of the suspect’s car. The vehicle had a Utah license plate. The officer stopped the vehicle at Oak and Chain streets, and the driver got out and walked toward the patrol car, according to court papers. The policeman got out of his vehicle, ordered the man to stop and patted him down for weapons.
The man, later identified as Flores-Garcia, was detained and handcuffed for suspicion of being the hit-and-run driver and put into the back of a patrol car.
While the officer was filling out paperwork, the suspect began yelling at him and saying, “I want to die,” and “I’m going to kill you cops today,” according to the affidavit.
Next, he kicked the right passenger door damaging the door and bending the window screen.
As a result of his behavior, another police officer brought shackles to the scene, and while police tried to shackle his legs, he kicked at them. While one officer was holding Flores-Garcia’s head, the suspect bit the other officer on the upper arm.
Eventually, the suspect was subdued and taken to Montgomery County Emergency Services in Building 50 for a psychological evaluation. Once they arrived at the facility, the suspect told an attendant he had used “acid” and possibly phencyclidine, known as PCP.
While there, he agreed to a breath test that indicated he was impaired.
Besides aggravated assault, the defendant was originally charged with making terroristic threats, criminal mischief, driving under the influence, leaving the scene of a crash, driving without a license and harassment. However, before his guilty plea, prosecutors dropped the other charges.
