Illegal Moose Meat, Prescriptions Drugs, and LSD seized

It's federal jail time for one and hefty fines for the other, as a pair of Woodstock business owners were sentenced on a number of charges Wednesday, including several drug-related offences.
Sonya Mackenzie and Trevor Hamilton are led into provincial court Wednesday afternoon. The couple was sentenced on a number of charges, and Hamilton was sent to federal prison. Mackenzie will also spend a week in jail and will have to pay some hefty fines. Trevor Grant Hamilton, 43, and Sonya Nicole Mackenzie, 33, both of Woodstock, were scheduled for trial on several charges relating to a number of incidents. However the pair changed their pleas on several charges, while other charges were withdrawn by the Crown.
In total, Hamilton was sentenced to three years in jail, to be served in a federal institution. Mackenzie was sentenced to seven days in a provincial institution, plus fines totalling $5,912.
Hamilton and Mackenzie, owners of Don's Taxi in Woodstock, were charged jointly under the Excise Tax Act, the Controlled Drugs and Substances Act, the Fish and Wildlife Act, and the Tobacco Tax Act of New Brunswick. Most of the charges stemmed from a search warrant the Woodstock Police Force executed on Jan. 12, 2008. They were also sentenced on charges stemming from a raid in March 2009.
On that date, members of the Woodstock Police, along with agents from the Canadian Border Security Agency and a K-9 unit executed a warrant at the couple's residence at 468 Main Street in Woodstock.
According to Crown prosecutor Ken Oliver, when police arrived, Hamilton was outside the home. Police showed him the warrant and arrested him.
Oliver said a quick search of the jacket Hamilton was wearing revealed 23 baggies containing a total of 14.7 grams of cocaine and 98 pieces of LSD. Oliver said the LSD had an estimated street value of $5 for each piece.
Mackenzie was inside the house. Oliver said she told police she didn't want to be searched in front of Hamilton's children.
Oliver told the court Mackenzie turned over a small bottle containing 0.6 grams of cocaine.
A search of Mackenzie's purse yielded a plastic baggie containing 13.9 grams of cocaine.
After the two were arrested, Oliver said, police conducted an extensive search of the residence.
According to Oliver, police found 14 plastic bags containing 200 illegal cigarettes in the master bedroom. There was also a bag in the closet containing 14.4 grams of solid form cocaine. A container with $1,387 in U.S. currency was found, as well as an air pistol, and ammunition.
Also found were two containers containing $510 and $527, all in Canadian funds.
Oliver said a freezer in the home was found to contain 350 pounds of illegal moose meat. Oliver said when police found the meat, they immediately contacted the Department of Natural Resources to deal with the meat.
The pair had been charged jointly under the Excise Tax Act for possession of the equivalent of 14 cartons of illegal cigarettes for the bags found in the bedroom. Mackenzie changed her plea to guilty on that charge and the Crown withdrew the charge against Hamilton. The minimum fine of $500 was imposed on Mackenzie and she was given until Oct. 6, 2009 to pay the fine.
Mackenzie also entered new pleas of guilty on two charges under the Tobacco Tax Act for possession of unmarked tobacco and being an unlicensed vendor with more than 1,000 cigarettes. On the first count, she was fined $1,000 plus a victim fine surcharge of $200 and given until April 13, 2010 to pay. On the second count, Mackenzie was fined $1,987 and given until July 13, 2010 to pay. The victim fine surcharge on the second count was waived.
The same charges against Hamilton were withdrawn by the Crown.
Under the Fish and Wildlife Act, Mackenzie entered a new plea of guilty for the possession of the illegal moose meat. She was sent to a provincial jail for seven days and fined $1,000. She has until April 13, 2010 to pay that fine. The same charge against Hamilton was withdrawn.
Under the Controlled Drugs and Substances Act, Hamilton entered pleas of guilty on charges of possession of cocaine for the purpose of trafficking and possession of LSD for the purpose of trafficking. Following a joint submission by Oliver and defence attorney Scott Fowler, Chief Judge R. Leslie Jackson sentenced Hamilton to two years on each charge, to be served concurrently. A 10-year firearms prohibition was imposed, and Hamilton will have to submit a sample of his DNA for the national databank. A portion of the Canadian currency found in the couple's home will also be forfeited to the court.
Before sentence was passed on Hamilton, Fowler told the court his client had served in the Canadian military as part of a peacekeeping mission in Cyprus, until he was seriously injured in a roadside bombing. Fowler said after Hamilton was discharged, he began to self-medicate.
"Without his medication he's essentially confined to his bed," Fowler explained. "This court should have some empathy and sympathy for Mr. Hamilton's plight."
Under the same act, Mackenzie pleaded guilty to possession of cocaine. She was fined $1,500 plus a victim fine surcharge of $225. She was given until Jan. 12, 2010 to pay the fine. She will also be on probation for 18 months, during which time she will be prohibited from possessing or consuming alcohol and non-prescribed drugs. She must also complete a substance-abuse assessment and a mental-health assessment and any follow up counselling resulting from those assessments. A charge of possession for the purpose of trafficking was withdrawn.
Mackenzie was also sentenced on a charge of breaching an undertaking for failing to report a change of address between Feb. 22 and March 7, 2009. Saying he felt the 40 days she had spent in pre-trial custody was sufficient, Judge Jackson suspended the passing of sentence for six months and placed Mackenzie on probation for six months.
Hamilton and Mackenzie were also scheduled for trial on Aug. 27 and 28 for a number of other charges. Most of those charges related to another police search at the couple's residence on May 30, 2009.
On that date, members of the Woodstock Police Force and District 7 RCMP executed a search warrant at the residence. During that search, police seized 100 Dilaudid pills and 286 pills of another, unidentified drug. The total estimated street value of all the pills, according to Oliver, was $6,430.
Oliver said no one was home when police arrived at the house. During the search, Mackenzie arrived at the home and was arrested. Oliver said Hamilton wasn't located until two days later when he showed up at the Woodstock court house for Mackenzie's bail hearing.
Following the raid, both were charged with possession of Dilaudid for the purpose of trafficking. On Wednesday, Hamilton changed his plea to guilty, and the Crown withdrew the charge against Mackenzie. Hamilton was sentenced to one year in jail, to be served consecutively to the sentences on the other drug charges.
Mackenzie had also been scheduled for trial on four breaches of an undertaking and an assault charge. Three of the breach charges and the assault charge were withdrawn by the Crown. Mackenzie pleaded guilty to a charge of breaching her curfew on March 31, 2009. Judge Jackson suspended the passing of sentence for six months and placed Mackenzie on probation for six months. The victim fine surcharge was waived.

moose me IS delicious. thats a lotta fines they gotta pay. I bet the only way they will be able to pay them is by some illegal means. AHHH the cycle continues.

For some fucking tobacco ! wheres the victim ? Ohhh uncle Sam that's right you didn't pay taxes on that unmarked tobacco lol. Actually though for all that coke and acid he would of been doing alot more time up state not to mention they raid him again on bail and he has 200 hydromorphone lol dudes lucky to not be serving 20 years in this country. Guess Ill have to ask for fed charges if I ever get busted again (knocks on wood)!

Yea, where I live a sizable part (sorry I don't have a percentage) of all the cigarettes that are smoked are considered illegal because they are bought and sold through the black market without permits or taxes. They are very cheap but at least 3x as harmful containing a lot more chemicals... You can get a carton of 200 cigarettes for as low as $15!!

This is the first article I've seen where they didn't blow the value of the drug out of proportion by tenfold.
