In yet another case of conflicting state and federal laws, medical marijuana users in Colorado cannot receive subsidies for or live in federal housing because they are categorized as substance abusers, the Denver Post reports.
According to the Post, the eviction of medical marijuana users from federal housing is becoming an increasing problem. Government housing has a number of requirements, including a ban on usage of illegal substances. Disability advocates point out that disabled people eligible for a medical marijuana ID card are often those most likely to need housing assistance.
Both the U.S. Department of Housing and Urban Development (HUD) and the registered medical marijuana user are obeying the law. The problem is, they are obeying different laws.
HUD is bound by federal law, which still categorizes marijuana as a Schedule I controlled substance. Other drugs on this list include mescaline, LSD, ecstacy and heroin.
Colorado, however, is one of the thirteen states that has deemed it legal for patients to undergo marijuana as medical treatment if a doctor prescribes it (14 other states have pending legislation regarding medical marijuana). As more states bypass federal drug laws and enact their own medical marijuana statutes, medical marijuana users will increasingly be caught in a legal grey area.
