Walnut Creek passes emergency moratorium on medical marijuana dispensaries

Walnut Creek leaders voted in emergency session Tuesday to ban pot clubs in an effort to delay a proposal for a medical marijuana dispensary.

The 45-day moratorium will put on hold efforts to put a "boutique-style" pot club at 1291 Oakland Blvd., just a few blocks from the BART station and downtown.

Lafayette and Orinda have imposed moratoriums, while the county's unincorporated areas and Pleasant Hill and Concord prohibit dispensaries. Pinole and Martinez have regulations governing pot clubs but the closest ones are in Berkeley, Oakland and San Francisco.

Walnut Creek does not have any laws on the books governing such establishments and City Council members asked for more information by Sept. 15 before revisiting the issue.

Councilman Bob Simmons voted against a moratorium. The father of a cancer survivor, he said blocking a dispensary giving out legal marijuana that might help patients who suffer from pain is "inexcusable."

Other council members wanted more study, citing concerns about neighborhood impacts. Councilman Kish Rajan said he wants to see if pot clubs create and attract illegal activity, as suggested in a city staff report.

Jay Hoyer, president of the Walnut Creek Chamber of Commerce, said the moratorium would give the community a chance to examine how a pot club fits in and how it would affect Walnut Creek's image.

"At first blush it doesn't seem to fit," Hoyer said. "I think its does not fit with our business mix if you look at the downtown or the retail mix we have here. It would be an unusual component to add to the mix."

The applicant, a group called C3 Collective, wants to expand an existing yoga, Pilates and acupuncture wellness center near Planned Parenthood and Mt. Diablo Boulevard. The nonprofit aims to counsel patients about medical marijuana and give out pot, merging "professional, experienced care with a chic boutique-style environment." C3 leaders said they were already giving out pot as "donations" to patients at the site.

City staff members said the business does not have a conditional use permit required for a wellness center, putting it in violation of city zoning regulations.

An attorney for Americans for Safe Access, a group that works to ensure access to medical marijuana, said the group is in compliance and that the moratorium will be challenged.

"The way (the moratorium ordinance) is worded is unconstitutional, and there will be challenges to it," attorney Scot Candell said.

Supporters of medical marijuana showed up Tuesday to lobby the council on behalf of family members who might use a dispensary and defend the proposed location. "There is no evidence crime is a factor. (Patients) don't deserve to be treated like criminals," said Mickey Martin with the Medical Cannabis Safety Commission.

David Ashburn, who lives near the C3 center, said Walnut Creek should allow pot clubs and make the proposed C3 facility a model for others.

"It's inevitable we are going to have medical marijuana dispensaries in this city," he said.

Medical marijuana has been legal in California since 1996, but dispensaries have faced crackdowns from federal authorities who do not recognize the state law. Supporters of the drug's medical use have been buoyed recently by comments from U.S. Attorney General Eric Holder that those abiding by state law will not be raided.

There you go Walnut Creek don't let cancer patients in your area or other very sick people have access to an herbal medication that works better than these rip off artists that make pills that have worse side effects than the symptoms the treat half the time.  :congrats:
