Wrong-way parking leads to 6-pound pot bust

KISSIMMEE - Wrong-way parking and a whiff of marijuana early Monday ended with Kissimmee police seizing a dozen gallon bags filled with pot in Mill Run on the city's northside.

The first things cops noticed about 1:15 a.m. was a black sedan parked facing traffic on Dana Lane and the familiar smell of burning marijuana, an arrest report states.

While the driver, John Javier Rojas, was telling police he was waiting for a friend to return home, a second vehicle carrying two men pulled alongside the parked car, rolled down its window and let out a a heavier smell of burned marijuana. Told to pull over, the driver of the second car sped into a nearby driveway and tried to walk into the residence, the report states.

Order to stop, the man later identified as Eric Camacho, 22, told police to "Go ahead" and search him but refused to let the officer search his car. When police found $4,048 in cash in his right pocket, Camacho said it was money to pay his rent .

Told by police they would search the car against his will, Camacho shoved an officer trying to handcuff him and ran toward the darkened house. Camacho opened a screen door just as the officer fired a Taser at him. The screening disabled the stun gun, letting Camacho open the front door and slam it shut in the officers' faces, the report states.

"I began to pound on the front door on the front door yelling that I was the police and to open the door," an officer wrote. " At this time lights came on inside the home and Camacho's father, Robert Camacho, came to the door with Camacho."

The younger Camacho refused to come out of the house until police grabbed him, pinned him on the ground and handcuffed him, reports stated. The wad of cash wrapped in $1,000 increments was found hidden between two flower pots inside the doorway, the report states.

A search of the dark green Acura TL sedan Camacho had been driving produced 16 gallon bags of marijuna, 12 of them each filled completely with a half pound of the drug. A weight scale was found in a passenger-side compartment, the report stated.

"The officer's attention to detail is to be commended," said Kissimmee police Chief Fran Iwanski, "By investigating a suspiciously parked vehicle, this officer was able to get a large amount of drugs off of the streets."

Jeannette Camacho, the suspect's mother, told police she had smelled marijuana before on his clothing but had never seen him with that much pot. Besides seizing the drugs, police seized Camacho's car for forfeiture.

The passenger in the Acura turned out to be Camacho's cousin, Samuel Robles, who told police the pot belonged to Camacho, the report states. Police did not release his age or address.

Camacho was arrested on nine felony charges, including possession and intent to sell marijuana and resisting arrest with violence. Police did not arrest Robles but recommended that the State Attorney's Office charge him with possession of marijuna with intend to sell and other drug trafficking crimes. Rojas, 22, no address given, who parked in the wrong, was charged with possession of less than 20 grams of marijuana.

Now.. lets see... first off, the officer smelled burning marijuana. In FL, paraphanelia is a misdemeanor (correct me if im wrong.), The article does not list the specific charges against him, only that it was nine FELONIES. So, my thoughts are... how the f*ck did they smell burned marijuana and find no pipes, roaches, etc? The man refused the search, but screwed up shoving the cop (is this basis for a search, resisting arrest?). Sounds like theres more to the story from the victims side regarding that matter. I hope this man gets a lawyer and has the evidence suppressed. Doesent mention a K-9 either. Some of you are VERY knowledgable about the laws and court systems, please do chime in. What do you guys think? Evidence obtained illegally, if not, why? Its a grey area to me, but perhaps someone can enlighten me one way or another.

Two weeks ago I posted a similar story where Florida cops likewise burned a guys house down in an attempted drug raid (no drugs recovered, no arrest). Theyre absolutely insane. I really hope this guy has some cash to get this evidence suppressed. Its funny how the article bluntly says he refused the search.. Unconstitutional, yet since its regarding 'less drugs on the streets' its ok.

They always seem to think the ends justify the means, no matter the means. Even if the 'means' are illegal.

As far as I know, an officer is trained and certified to justify the smelling of mary j as means to a search. Pushing the asshole didn't help either. The cop did not ask to search, he didn't have to.
I'm sure more than half of us have been searched just because we smell like weed, or someone left a stem/seed on the floor of the car.

that doesnt hold up when a cop "smells pot" in your house. It is not probable cause for a search of ones home. :shrug:

Yeah, and they didnt call a dog. Grant you we have less rights in a car then in a house, wouldnt they need more cause? I'll check the thread again in an hour or so, relocating my comp. Thanks for all the replies, knowledge > prison.

I think we have more rights at home than in a car because we drive cars on public streets. Which are government property. I think if the car is on private property the same rules as a home investigation apply.

Pot smokers should start lighting up liquor store with Molotov cocktails, maybe then we will get the attention from the hypocrites :mad2:

The number one rule you follow when you have drugs in your car is to obey all the rules. There was some bad decision making by javier here. He was too lazy to park the car on the right side of the road? Doing anyything illegal requires care.
