Battle Isn't Over For Medical Marijuana Advocate

When Bryan Epis stepped outside federal prison in 2004 he knew his freedom may be only temporary.

He'd been serving a ten year sentence for cultivating marijuana when his lawyer won him an appeal.

His troubles began after California voters passed Proposition 215, legalizing medicinal marijuana, something Epis had been using for several years.

With a doctor's prescription in hand, Epis says he grew marijuana plants inside his Chico home for himself and others.

For Epis, the saga began in June of 1997 when drug agents seized more than 400 medical marijuana plants from the basement of his home here on West Francis Willard.

The U.S. Attorney's Office, undetered by state law, prosecuted Epis for growing marijuana with the intent to sell.

He made headlines by becoming the first person prosecuted since the legalization of medical marijuana.

Epis got his appeal, all the way to the U.S. Ninth Circuit Court of Appeals and lost.

Last month, three Ninth Circuit justices ruled that Epis had no reason to believe that California's medical marijuana law would protect him from federal law.

But he's not willing to go behind bars again without a fight.

Epis and his attorney have already decided to ask for a rehearing.

so why arent we arresting pharmacy production executives every time someone is caught with any of the other prescription drugs.

I remember being in DARE when i was much younger and some of the stories they would tell you are not only ridiculous, but completely untrue. One story was that a woman was on LSD and thought her infant was a turkey so she baked it in the oven. Now I look back and think thats hilarious, but at the time I guess it scared me.
