How To Destroy Federal Drug Laws

Hypothetically speaking, this is how the war on drugs will fall.
1. California needs to grow a sack (when Arnold is out of office).
2. The State of California is to challenge the federal laws of the United States concerning drugs. (Supreme Court)
3. California pleas..."The State of California wishes to prove that the United States of America has violated her Constitutional State rights by way of the deliberate disregard for the tenth amendment of the United States Constitution; which states, 'The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.'"
4. The United States defends..."Under Article VI, Clause 2 of the constitution of the United States, 'This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the authority of the United States, shall be the supreme Law of the land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.'"
5. California counters...(and this is the key people)..."Pursuance of what? There are two options one can choose, both of which are directly stated within such clause, that any law made in Pursuance of the Constitution or United States Republic shall be the law of the land. In other words gentlemen, such a law would have to be essential to the security and longevity of such a Union or Constitution. How exactly do the drugs made illegal by your federal laws threaten to destroy the safety of the establishment?"
War Over if the Supreme Court today still honors the Constitution.
-Federal Laws, for example, that do take precedence over state, are the 13, 14, 15 etc. all of which were deemed necessary to the success of the Union. Read these amendments and the ones after. Almost everyone created was done so in order to eliminate threats to the republic and/or the constitution.
In order for the war on drugs to hold any ground, an amendment must be made creating such law. It must be proven that the legalization and free market of drug sale would threaten the Union.

The key word here is "if", if the supreme court still honors the constitution. I have doubts that they do. If they did this war on the people of the United States of America would have been over years ago.
You did give a good argument tho and I hope this comes true.

Your arguments sound good to me! In fact, regarding Point 5, you could argue that drug prohibition threatens the State of the Union by bolstering organized crime and the blackmarket. Extreme examples of this situation include, but aren't limited to, Mexico and Colombia.

With that said, look at every city in the country, gang violence is everywhere and alot of it is fueled by drug turf and shit like that. By legalizing marijuana (or any other drug) it would give the gangs less to fight about and make the streets a bit safer.

Now that I think about it, the tenth amendment states, "...or the people." which consequently gives any individual person the right to challenge these federal drug laws.
For any federal law that does not fall under the Supremacy Clause (as mentioned above) and wishes to have validity, must be amended.
Prohabition was created with an amendment and repealed with another. Drug laws today are null and void on the federal level; PERIOD.
