which would carry a higher penalty?

I havent been able to find the answer to this....
Since DMT looks like it could be crystal methylamphetamine, and they found a baggy of it, and tested it,
would you be in more trouble because its a schedule 1 and methylamphetamine is schedule 2?
or is that one of those case study things?
I am sure very few people get caught with DMT, I think a lot of D.A's would be like "ok, its illegal, WTF is it?"
I know pot is decriminalized to the point of petty offense (like here in colorado) and is schedule 1.
pot however is closer to legalization than anything else, and considered so benign by most people. so it falls under jurisdiction.
are things charged as "possession of a controlled substance" in most places? thats what i have seen.
for the sake of arguement, lets consider the weight on any of these things the same.

Controlled substance schedules have nothing to do with legality or penalties for possession, manufacture, etc. as you pointed out with your marijuana statement.
The same can be said for LSD, mescaline and psilocybin which are schedule 1 and incur usually light penalties for possession, whereas cocaine, synthetic opiods schedule 2's carry heavy sentences for possession.

yeah, i figured it had more to do with "recognized medical use"
theres so much schedule 1 shit on there, even with the knowledge from erowid and here, 80% of that stuff is "wtf is that?"
I dont think anything should ever be schedule 1.
pot? you should just be able to buy that at the gas station, or better yet, cut out the crime aspect and just let people grow their own.

What's the point of even having a schedule I if nothing is?

what they consider schedule 1 is bullshit, there should be some use for all the things on schedule 1.
