 Baby smokes from bong: Court upholds mom's conviction

SAN FRANCISCO, California (Reuters) -- A Montana mother who allowed her 18-month-old baby daughter to inhale from a marijuana water pipe was properly convicted, but should not have to spend five years in jail, a U.S. appeals court ruled Friday.
Jessica Durham was photographed allowing her toddler Michala to suck from a marijuana water pipe, also known as a bong, in 2004 by a friend upset about the activity.
"Ms. Durham allegedly remarked that smoking improved Michala's appetite and left Michala lethargic and mellow - a manner she found consistent with her own experience smoking marijuana," Judge Louis Pollak of the U.S. 9th Circuit Court of Appeals wrote in summarizing the case.
In 2005, a lower court sentenced Durham to five years in prison for unlawful marijuana distribution. She appealed both the conviction and the sentence.
In its ruling Friday, a three-judge panel of the 9th Circuit upheld the conviction but said the sentence exceeded the applicable federal law which calls for punishment of no more than two years in prison.

That is kinda wrong, don't give the baby weed so young. Weed is pretty harmless, but probably not on such a developing body.

Yeah. Marijuana's a safe drug, but it has no place in the body of an 18 month old.

I'm in favor of keeping kids' bodies free of contaminants until they are old enough to make the decision for themselves.
Poor judgement on the part of the mother, but I'm sure she just needs an education, not jail time.

Don't you have to be 18 to get Salvia and legally use it?
And I second the whole contaim free, I was very anti-drug in my school, EVERYONE knew me for it, and its even in my dislikes my senior year of high school in the yearbook!!! Dislikes: Drugs.
Then I was 18 1/2 and decided to try mushies for the sake of hallucinating and to feed my wild imagination. Well, it worked, and here I am now but like I tell everyone I've had 18 1/2 years of sobriety I just turned 22, and I'm using for a purpose thats too big for me to realize yet. But when the time is right and I'll KNOW WHEN I'll stop!
