Peoria couple wants DXM outlawed

Frarys testify to lawmakers about how their son died of overdose of legal drug

Seeking to spare other families from similar pain, a Peoria couple whose son died of a drug overdose testified Thursday in Springfield for a proposal to outlaw the pure form of a substance called DXM.

Jonathan Frary, an Illinois State University senior and son of Greg and Linda Frary of Peoria, died in September 2003 in his Normal apartment. He was 22.

The McLean County coroner's office determined he died from an overdose of dextromethorphan hydrobromide, and a coroner's jury ruled the death as accidental. Dextromethorphan, or DXM, is an ingredient in some cold and cough medicines.

A pure form of the drug can be bought over the Internet, said Rep. Dan Brady, a Bloomington Republican who is one of the key backers of House Bill 4300. The pure form, a white powder, acts as a hallucinogen.

"Jon was a terrific son," Linda Frary told lawmakers on the House Judiciary Committee on Criminal Law.

Even though he long had talked of becoming a fighter pilot, like his grandfather, Jon later changed his mind and majored in psychology at ISU, she said. He was especially interested in dream research.

"Jon apparently thought he could use this legal drug to enhance his dreams," Linda Frary said.

One of Jon's friends later confirmed that was true, Greg Frary said. The Frarys also learned their son had purchased the drug over the Internet.

"This is what we're really after - to get rid of the ability to get pure DXM," Greg Frary said.

House Bill 4300 would make possession of the pure form of DXM a Class 4 felony, generally punishable by up to three years in prison. Selling or distributing pure DXM would be a Class 2 felony, generally punishable by up to seven years in prison.

Rep. Chapin Rose, R-Mahomet and another sponsor of the bill, said the measure would not apply to cough medicine, liquid capsules or similar forms of medication.

The committee voted 16-0 for the bill, which now goes to the House floor. Rep. Robert Molaro, a Chicago Democrat who chairs the panel, praised the Frarys for their remarks, telling them: "You do your son proud."

To become law, the legislation must pass in the House and Senate and be signed by the governor. Peoria Reps. David Leitch and Aaron Schock, both Republicans, also are sponsoring the measure.

No, Jon took the drug because he wanted to get fucked up and trip, not because he wanted to enhance his dreams.

Congrats, Jon is yet another victim of the War on Drugs. If we honestly educated our children about the real dangers, the real benefits, and the real effects of drugs, then most likely Jon would still be alive. The irony is that the parents are adding to the problem, not making it better, by trying to make yet another substance illegal.

*sigh* No... all forms act as a dissociative. The only difference between the pure form and the "un-pure form" is the amount of filler and other garbage they add into the mix.

Based upon recent news stories/hype about DXM, I give it at most two years before it is listed by the Federal government.

Too bad he had shitty parents that let the internet and television babysit him rather than giving him the attention that they should have. But then, I guess it is much easier to blame somebody else for mistakes made than to take responsibility for ones own failures. Where exactly were the parents when Jon dosed?

So all they are doing is making sure that everyone has to drink nasty cough syrup to get their DXM.

A felony for pure DXM, but put it in some nasty tasting syrup and *poof* it becomes LEGAL!!

I am curious what DXM will be replaced with in cough syrups if it is banned... It replaced codeine... What more dangerous and less effective chemical will they substitute with this time?

My guess is they wouldn't replace it and would simply market antihistamines like diphenhydramine or dimenhydrinate more.

Also extracting DXM from cough syrup can be done in 2 hours. This aint going to stop shit...

Adding tylenol to pretty much any substance would prevent abuse, I figure basically the people at Robotussin and similar brands are making too much at the moment. They'll milk this until the government does something, even the commercials seem to hint towards other uses sometimes....
